Preliminary provisions

discordextremelist.xyz (the "Site" or "We") is owned and operated by Carolina Mitchell, Advaith Jagathesan, and John Burke (collectively "Discord Extreme List"). For the avoidance of doubt, where applicable, Discord Extreme List is also to be taken to include any staff part of our organisation.

The purpose of the Site is to provide the services listed at the top of this privacy policy to end-users and those utilising the Site for promotion, and other related purposes.

Personal data collected

We only collect data that helps us achieve the purpose of the Site set forth in the Preamble.

1. your Discord account information if you login to the Site with your Discord account through our OAuth2 flow; and
2. any other information you manually provide to the Site through any of its forms.

Do not track signals

Do not track ("DNT") is a preference you can set in certain modern website browsers. We do not track users of the Site across other third party websites and as a result we do not respond to DNT signals. We are not responsible for and cannot guarantee the integrity of the response of any third parties to DNT signals on our Site who may interact with your data.

Use of personal data

Data collected on the Site will only be used for purposes specified in this Privacy Policy, to fulfil the purpose of the Site within the Preamble, or as otherwise indicated across the Site or our services. Your data will not be used beyond what we disclose in this Privacy Policy.

The data we collect automatically is used for the following purposes:

1. Internal service logs; and
2. Website statistics; and
3. Monitoring website security; and
4. Monitoring website errors and issues that arise.

The data we collect when the use performs a function that triggers non-automatic data collection may be used for the following purposes:

2. Allowing the user to utilise the advertising part of the Site (to advertise their Discord bot, server, or template); and
3. The facilitation of account creation and other related purposes.

Sharing of personal data

Employees

We may disclose information to any staff member of Discord Extreme List who reasonably needs access to user data to achieve the purposes set out in this Privacy Policy.

Third parties

We may share the following user data with the following third parties:

1. Google Analytics, all automatically collected data; and
2. Cloudflare, all automatically collected data as a result of your use of their proxy to access the Site and analytics purposes; and
3. Sentry, such as session information, your browser and operating system information, and other automatically collected data.

International data sharing

Your data will be principally stored in the United States of America, however, may be directly accessed and transferred from time to time from Aotearoa New Zealand, or anywhere in the United Kingdom or the European Union.

When we transfer user personal data internationally we will protect that data as set forth in this Privacy Policy and comply with all other legal requirements for transferring personal data internationally. Furthermore, in the case of users located in the European Union or United Kingdom ("UK"):

1. we will only transfer your personal data to a country if it has been deemed to have adequate data protection by the European Commission, or by UK adequacy regulations (whichever is applicable); or
2. we have implemented appropriate safeguards in respect of the transfer.

Other disclosures

We will not sell your data under any circumstance, whether to a third party or any potential buyer.

Users who are accessing the Site from Aotearoa New Zealand have the rights set forth in the Privacy Act 2020 (NZ)'s information privacy principles (IPPs) and other related information in that Act.

It is the responsibility of the user to periodically review the Privacy Policy to ensure they are up-to-date with the latest Privacy Policy. Users are bound by any amendments to the Privacy Policy if they fail to discontinue use.
